Recruitment requirements
The new Points Based System requires that certain codes of practice are followed when recruiting to a new position within the UK. From July 2010, a limit has been put on the number of Tier 2 Certificates of Sponsorship we can issue.
If you are recruiting to a new post and would like to have the option of appointing an overseas individual, speak to your HR Business Partner in the first instance. The following information is relevant to those recruitment campaigns where it has been agreed with Human Resources there will be the opportunity of issuing a Tier 2 CoS. In that case, it is important to think about the following points well in advance of your recruitment.
Salary
There are varying minimum annual or hourly salary requirements depending on the type of position to which you are recruiting. Some of the most common requirements are:
- Research job family: £15,641 pa
- Education and Research/Education and Scholarship job families: £23,449 pa
These salary requirements cannot be pro-rated for part-time members of staff.
Job description and person specification
Under the new arrangements, it will be necessary to satisfy a ‘Resident Labour Market Test’ (RLMT) to ensure that ‘settled workers’ have had the opportunity to apply for the job before it is filled under Tier 2 – ie advertising the job and confirming that no suitably qualified settled worker can fill the job.
It is extremely important that the job description and person specifications are accurate for the requirements of the post as the panel will use these criteria to shortlist and appoint.

Where to advertise
The RLMT has varying requirements for advertising locations depending on the type of position to which you are recruiting. For a majority of posts this will include advertisement on www.jobs.ac.uk and the Jobcentre Plus websites. However, these will not cover the requirements for all posts, so please contact your HR Business Partner for further advice about where to advertise.
How long you will need to advertise
For academic posts the requirement to advertise within the University in the first instance is waived. However, in order to meet the requirements of the RLMT, each post must be advertised in the appropriate media for no less than 4 weeks. These do not need to be consecutive weeks - please contact your HR Business Partner for more information.
The University is not required to satisfy the RLMT for researchers who are named in the grant.
