After certain forms of brain injury we may ascribe a label of personality change to patients. This terminology captures the extensive alterations in affect, behaviour and preferences that can lead to a patient appearing fundamentally altered in comparison with their pre-injury self. Personality change often entails changes to the decision-making process, bringing these patients under the aegis of mental capacity law. In this talk I explore the strengths limitations of the mental capacity framework in safeguarding these patients' autonomy and wellbeing. I suggest that current thinking about capacity in this context pulls us in different and contradictory directions, and that personality change thus presents a challenge to current mental capacity law.
